Terms of service
This Public Agreement, posted on the website https://oneluxy.com, constitutes an official offer from the Online Store to conclude a public purchase and sale agreement. This Agreement regulates the remote sale of Goods via the Internet, namely the voluntary selection of Goods in the Online Store, independent order placement, payment, and delivery of Goods under the terms of this Agreement.
In accordance with Articles 633, 641, and 642 of the Civil Code of Ukraine, this Agreement is general and open to all individuals who temporarily or permanently reside in Ukraine, possess full legal capacity and ability to act, and understand the legal significance and consequences of their actions. This Agreement is equivalent to a written contract signed between Buyers and the Online Store. The Buyer may not propose their own terms for concluding the Agreement and accepts the terms regarding order placement, payment, and delivery of Goods.
1. Definitions
1.1 Online Store — the website located at https://oneluxy.com, acting as the official distributor of the “Oneluxy” brand products. The website publishes Goods and provides order processing services. The Online Store is not a manufacturer but cooperates with Suppliers who produce Goods under the brand owned by the Online Store.
1.2 Content — intellectual property of the Online Store, including but not limited to:
- 1.2.1 Software code containing all scripts, algorithms, and technical components ensuring the functionality and interaction of the Online Store with Users.
- 1.2.2 Design elements of web pages, including color schemes, fonts, layouts, and other interface appearance features.
- 1.2.3 Descriptions of Goods, including specifications, sizes, materials, country of origin, and other important information.
- 1.2.4 Articles, blogs, and useful materials on fashion, style, trends, and clothing combination advice.
- 1.2.5 Photo and video materials demonstrating the appearance, functions, and usage of Goods.
1.3 Personal Account — a service provided by the Online Store allowing authorized Users to view order history, add Goods to a wishlist, view the shopping cart, edit personal data, and use bonuses and loyalty programs.
1.4 Personal Data — information enabling identification of the User and necessary for ordering Goods.
1.5 Supplier — an individual entrepreneur and/or legal entity providing Goods produced under the brand owned by the Online Store, based on an agreement with the Online Store.
1.6 Goods — branded clothing, accessories, and lingerie presented in the Online Store and available for purchase by the Buyer.
1.7 Cookies — small text files storing information about the User’s previous actions in the Online Store, such as visit date and time, language preferences, etc.
2. Conclusion of the Agreement
2.1 Registration on the Online Store and/or ordering Goods without registration confirms that the User accepts the terms of this Agreement and gives full and unconditional consent to its conditions (hereinafter referred to as the "Acceptance"), without the need for signing a written version by the Parties. If the Buyer disagrees with the terms, they may not place an order or register.
2.2 By concluding the Agreement, the Buyer confirms they have personally read and agreed to all terms. The Agreement becomes effective upon Acceptance and remains valid until obligations are fulfilled by both Parties. The place of Agreement conclusion is Kyiv.
3. Registration and Authorization
3.1 The Online Store allows Users to select and order Goods without registration; however, based on provided data for order processing, the Online Store registers the User. For access to additional services, loyalty programs, personal discounts, and the Personal Account, registration is required.
3.2 To register, Users must provide last name, first name, email, and contact phone number. Registration implies automatic subscription to informational messages via email, Viber messenger, or SMS.
3.3 Users can authorize using a phone number and access code via Viber and/or SMS, or by entering email and password, or via Google, Apple, or Facebook accounts.
3.4 In case of lost password, Users may request recovery. A link will be sent to the registered email.
4. User Personal Account
4.1 After registration and authorization, Users receive access to their Personal Account to view and edit personal data, check bonus balance, and receive order/payment confirmations.
4.2 Personal Data: Users can edit their contact details and change passwords if registered via email or phone number.
4.3 Bonus Account: Users may use bonuses from previous orders to pay for Goods. In the shopping cart, choose the “Balance” payment method. For questions, contact Online Store support.
4.4 Orders: Users can view, archive, or delete their orders in the Personal Account.
4.5 Payment Notifications: After ordering and payment, Users can notify payment via Personal Account and/or receive confirmation from a manager. Fiscal receipts are sent via SMS and/or email.
5. Online Store Services
5.1 Product Catalog: Divided by categories, collections, product descriptions, promotions, and discounts. Names and content may change.
5.2 Size Selection: Size charts for clothing, lingerie, and footwear are available. Users may consult managers for measurement advice.
5.3 Wishlist: Users can add preferred Goods and sizes to a wishlist and move items from wishlist to cart.
5.4 Search: Search by product name, category, or article number.
5.5 Shopping Cart: Users add Goods to the cart, check details, select quantities, payment, delivery, discounts, certificates, promo codes, or bonuses. Premium packaging is available for an additional fee, payable online or by invoice.
5.6 Ordering: Users may order any available Goods in unlimited quantities. If Goods are out of stock, managers notify Users via email, Viber, SMS, or call. Orders are valid when all identification and delivery fields are correctly filled.
5.7 Currency and Language: Users can set the language and currency display. Prices shown in foreign currency are for marketing purposes; payments are converted to Ukrainian hryvnia at the bank’s exchange rate processing the payment.
6. Payment for Goods
6.1 Payment. The Buyer may pay for the order using the Bonus Account in the User's Personal Account, Visa and MasterCard cards, and/or via Apple Pay/Google Pay. In the case of payment by bank transfer to the settlement account, shipment of the Goods will be made after payment confirmation in the Personal Account or through the Online Store manager. For payments made via the “LiqPay” payment system, no payment confirmation is provided. The Buyer may pay by transferring funds to the settlement account using the specified banking details. After payment, the Buyer receives the corresponding data via email.
6.2 When paying by non-cash methods such as Visa or MasterCard cards, the Buyer pays on the Application page. For payments via the “LiqPay” system, the Buyer pays on the payment system’s secure page, protected by security certificates. Buyers pay only the cost of the Goods; no additional online payment fees apply. Non-cash payments are subject to the terms of the “LiqPay” payment system. The Buyer may use the “installment payment” service, splitting the payment into 3 parts. Terms for installment payments are provided upon request in the Online Store.
6.3 To avoid additional fees when paying for Goods, we recommend using the non-cash payment method directly in the Online Store.
6.4 Receipts and payment confirmations are provided to Buyers via Viber messenger and/or SMS immediately after payment.
7. Price of Goods
7.1 The price of the Goods is the price listed on the Online Store. This price is binding under the Agreement except in cases of obvious errors. Despite efforts to keep prices up to date, errors may occur. If a price error is detected for Goods ordered by the Buyer, we will promptly notify the Buyer and offer the choice to confirm the order at the correct price or cancel the order.
7.2 Prices may change at any time. However, except for cases mentioned above, price changes do not affect orders for which order confirmation has already been sent.
8. Delivery of Goods
8.1 Delivery. We deliver Goods via “Nova Poshta” or “UkrPoshta” postal services, courier services “Nova Poshta”, “UkrPoshta”, “Uklon”, “EMS”, and courier delivery within Odessa city. The Buyer selects the delivery method when placing the order. The list of delivery methods is not exhaustive and may be updated; details will be published on the website.
8.2 Typically, shipment occurs after 6:00 PM. Delivery times range from 1 to 10 business days depending on stock availability at the Online Store warehouse and retail stores. Delays may occur during public holidays or due to stock shortages. If goods are unavailable, the manager will inform the Buyer and agree on delivery timeframes or arrange an exchange or refund per the return procedure. The Online Store may offer international delivery; delivery times depend on the destination country, customs, and border procedures, generally from 10 to 90 days. The Buyer assumes responsibility for customs clearance and duties if the value exceeds the duty-free threshold.
8.3 After shipment, the Buyer receives the tracking number (TTN) by email, SMS, and/or Viber messenger. Delivery is confirmed upon receipt by the Buyer at the specified address or pickup point.
8.4 Delivery is available throughout Ukraine except for regions under force majeure conditions: Crimea, Luhansk and Donetsk regions, and certain towns and villages in Kharkiv, Kherson, Zaporizhzhia, and Sumy regions.
8.5 Upon receipt, please inspect the Goods for damage and compliance with quality specifications. If packaging or Goods are damaged, request a damage report from the courier or pickup point staff.
8.6 Goods may be shipped in several packages depending on quantity, size, compatibility, suppliers, storage locations, payment and delivery methods, and total order value. The number, approximate cost, and delivery cost of each shipment are shown in the Cart. The Online Store is not responsible for final delivery costs, which are set by the delivery service provider.
9. Returns and Exchanges
9.1 Returns and exchanges are governed by the Law of Ukraine “On Consumer Rights Protection”. The Buyer has 14 calendar days from receipt to return or exchange Goods if they do not meet expectations regarding form, size, style, color, or other reasons preventing intended use.
9.2 Returns/exchanges of Goods in proper condition or those not fitting for any reason are accepted if:
- 9.2.1 The Goods are unused and show no signs of wear;
- 9.2.2 Consumer properties and appearance are preserved;
- 9.2.3 Tags, labels, and original undamaged packaging are intact;
- 9.2.4 The Buyer pays delivery costs for return or exchange.
9.3 If the Buyer receives Goods differing from the order in color, article number, or having manufacturing defects making use impossible, the Buyer may return/exchange them within the legal period. Delivery costs for return in this case are covered by the Online Store.
9.4 Goods sold as damaged or discounted due to quality issues are not subject to return/exchange. The Buyer agrees to these conditions and waives claims regarding refusal of returns/exchanges for such Goods.
9.5 Ukrainian law prohibits return of used Goods, Goods customized for the Buyer, and Goods not subject to return for hygiene reasons, including underwear, bodysuits, pajamas, corsets, swimwear, opened or tried-on hosiery and socks.
10. Return and Exchange Procedure
10.1 To return Goods, the Buyer must fill out the return form sent with the order and ship the Goods to the address specified on the form. For refusal of cash-on-delivery orders at pickup, the Buyer must fill out the return form on site, send back the Goods, and indicate refusal at the pickup point.
10.2 Upon receiving returned Goods and confirming their proper condition, the Online Store refunds payment within 7 days to the Buyer’s bank account from which payment was made. If access to the card is unavailable, the refund will be made to the original card and the Buyer will receive a payment reference code to assist with transfer to an active card. For cash-on-delivery returns, the Buyer may use the funds for future orders or request a refund, which will be arranged with the manager.
10.3 If signs of use, washing, damage, odors, stains, or cosmetic residues are found, the returned Goods will be sent back to the Buyer at their expense and will not be refunded.
10.4 For exchanges, the Buyer fills out the exchange form sent with the order, specifies the new Goods, ships the original Goods to the provided address, and contacts the manager to reserve the replacement. Price differences must be settled per manager’s instructions. Exchange shipments are sent after the Online Store receives the returned Goods.
10.5 Returns or exchanges of discounted Goods purchased in sets must include all items ordered. Partial returns or exchanges are not accepted.
11. Removal of Goods. Refusal of Order Processing
11.1 The Online Store reserves the right to remove any Goods or change descriptions. While efforts are made to ensure quality and accuracy, the Online Store is not liable for consequences of such actions.
11.2 Despite efforts to process orders, circumstances may force refusal of order processing even after order confirmation. The Online Store reserves this right and is not liable for any consequences of such refusal.
12. Loyalty Program and Bonuses
12.1 ONELUXY has established a loyalty system granting Buyers privileges such as gifts from Oneluxy friends, discounts, exclusive sales, birthday gifts, invitations to events, surprises, and assistance with dating or photo sessions.
12.2 Additional promotions are offered seasonally or during special events, such as birthday discounts, “Wheel of Inspiration,” collection sales, and discounts.
12.3 The list of promotions and loyalty programs is not exhaustive and may be updated or removed by the Online Store at any time.
13. Suppliers
13.1 The Online Store cooperates with various Suppliers providing Goods under the Online Store’s brand. These Goods are offered and sold via the Online Store platform.
13.2 The Online Store maintains confidentiality regarding its Suppliers and does not disclose supplier details to Users.
13.3 For payment convenience, the Online Store and payment system may provide banking details of Suppliers to facilitate order processing.
14. Rights and Obligations of Buyers
14.1 The Buyer has the right to place orders for Products without registration, register on the Online Store website to gain access to the Personal Account and services, order and receive Products, refuse the purchase and return Products, unsubscribe from the Online Store’s mailings, use bonuses, discounts, and the loyalty program, familiarize themselves with the terms of Personal Data processing and restrict its use in accordance with the terms of the Agreement, leave feedback, and choose the method of delivery for the Products.
14.2 The Buyer is obliged to comply with the terms of the Agreement, pay for and accept the ordered Products according to the conditions stipulated in the Agreement, review the instructions before using the Products and follow the terms of use, use the Online Store’s Content only in the permitted manner, and protect access to their Personal Account from unauthorized third-party access.
15. Rights and Obligations of the Online Store
15.1 The Online Store has the right to publish, modify, or remove Products and their prices; provide, change, or cancel promotions, discounts, and the loyalty system; receive payment for Products; refuse sale to a Buyer if they violate the terms of the Agreement; publish supplier Products on the Online Store; publish, not publish, or remove User reviews; and protect copyright and intellectual property rights.
15.2 The Online Store is obliged to provide the Buyer with information regarding the Products, carry out exchange and return of Products in accordance with the Agreement, perform all necessary actions for the delivery and payment of Products by the Buyer, review User requests and complaints, and store and not disclose Users’ Personal Data, except as required by law or this Agreement.
16. User Consent
16.1 The User agrees not to perform unlawful actions, not to use fraudulent methods or system vulnerabilities aimed at disrupting the Online Store’s operations, as well as refrain from spam, mass mailings, and flooding.
16.2 The User agrees not to use automated software, emulators, bots, or any other unauthorized third-party software intended to modify or interfere with the Online Store’s software.
16.3 The User agrees not to create multiple Personal Accounts on behalf of one individual and not to share access to their Personal Account with third parties to maintain confidentiality and User rights.
16.4 The User agrees to promptly notify the Online Store in case of loss of access to the Personal Account due to unauthorized third-party access.
17. Advertising Opt-Out
17.1 If the Buyer does not wish to receive information about Product offers/advertising and/or information about the Online Store’s promotions and discounts, they have the right to contact the Online Store’s managers to request to unsubscribe from promotional materials and/or send a request to unsubscribe via email and/or messengers of the Online Store.
18. Personal Data Protection
18.1 By accepting the Agreement, the User consents to the collection and processing of their Personal Data for the purpose of receiving services from the Online Store. The list of Personal Data processed by the Online Store is defined in this Agreement, namely in the registration, authorization, payment, and delivery sections.
18.2 We strive to protect and keep confidential the Personal Data provided by Users. To this end, we have implemented appropriate rules and technical measures to protect data under our control from unauthorized access, misuse, disclosure, alteration, destruction, or loss, in accordance with the Law of Ukraine "On Personal Data Protection."
18.3 While you remain a User of the Online Store, you grant the Online Store the right to process, transfer, store, and back up your Personal Data to provide services under this Agreement, including receiving and processing order information and sending commercial communications for marketing purposes.
18.4 The Online Store guarantees that Users’ Personal Data is treated as confidential and will not be transferred, disclosed, or otherwise made available to any third party except for employees, Suppliers, or carriers who need such data for the purposes of this Agreement.
18.5 The Online Store undertakes not to disclose the Buyer’s Personal Data and complies with the Law of Ukraine “On Personal Data Protection,” except in cases where Personal Data must be disclosed to authorized state authorities in accordance with law or when Personal Data is openly shared by the Buyer.
18.6 You can review the Online Store’s Privacy Policy at the internal link [https://gepur.com/privacy]. The Privacy Policy applies to Users during Personal Data processing for marketing, analytical, and statistical purposes, as well as to improve the Online Store’s functionality.
19. Use of Cookies
19.1 We use cookies to improve and simplify User interaction with the website. Cookies are necessary to save your settings selected in the Online Store, such as language preferences. We use cookies in compliance with GDPR requirements and relevant guidelines issued by the EDPB. We rely on User consent and the legitimate interests of the Online Store under Article 6 GDPR when using cookies and similar technologies.
19.2 The Online Store uses essential and additional cookies. Essential cookies are always used and are necessary to ensure the Online Store functions properly. Additional cookies are used only with User consent. Users can decide to accept cookies fully or partially, or block or delete cookies; however, refusal to accept essential cookies may limit functionality on the Online Store website.
20. Intellectual Property
20.1 All intellectual property rights, including copyrights, trademarks, and other ownership rights regarding the Content placed on the website and social media of the Online Store, belong to the Online Store. Unless explicitly stated otherwise, Users must assume all Content and ownership rights are protected by intellectual property laws and cannot be used beyond what is permitted in this Agreement.
20.2 Users have no rights to any Online Store Content and agree not to copy, republish, modify, distribute, license, or create derivative works based on the Online Store’s Content and services, except as permitted by this Agreement.
20.3 Unauthorized use of the Online Store’s intellectual property is strictly prohibited. The Online Store will enforce its intellectual property rights under Ukrainian law. User use of Online Store Content is governed by this Agreement.
21. Guarantees
21.1 The Online Store’s obligation to deliver an order is considered fulfilled at the moment the Product is handed over to the delivery service. The risk of loss or damage to the Product after transfer to the delivery service lies with the Buyer.
21.2 Regarding the quality of its own Products, the Online Store guarantees compliance with quality standards provided the Buyer follows the usage, intended purpose, and technical specifications of the Product. The Online Store is not responsible for Product quality if the Buyer uses it improperly or ignores instructions on the Product label.
21.3 If delivery is made by the “Nova Poshta” service, the Online Store does not guarantee delivery quality or conditions. In this case, “Nova Poshta” is responsible for delivery. Their terms can be found via the internal link.
21.4 If delivery is made by “UkrPoshta,” the Online Store does not guarantee delivery quality or conditions. In this case, “UkrPoshta” is responsible for delivery. Their terms can be reviewed at the internal link [https://www.ukrposhta.ua/].
21.5 The Online Store provides no guarantees regarding availability. We are not responsible for any consequences if the Online Store becomes unavailable to the User at any time. Furthermore, the Online Store cannot guarantee to be free of harmful or defective elements at all times. Users agree not to hold the Online Store liable for any technical problems, failures, software issues, access or bandwidth limitations, security breaches, unauthorized access, or other similar issues, including those arising from User-side access.
22. Liability
22.1 The Online Store is not responsible for any changes in appearance, composition, or packaging of Products made by Suppliers, but strives to update information about such changes promptly.
22.2 The Online Store is not liable for Product defects occurring after delivery to the Buyer, which may result from misuse, improper storage by the Buyer, third-party actions, or force majeure circumstances.
22.3 The Online Store is not responsible for the processing of Users’ Personal Data or payment processing by the "LiqPay" payment system.
22.4 The Online Store is not liable for improper or non-fulfillment of obligations caused by the Buyer providing outdated or incorrect Personal Data during order processing.
22.5 The Online Store is not liable for limited website functionality due to lack of Wi-Fi or mobile network access. When using the Online Store outside Wi-Fi zones, your mobile provider’s terms and charges apply. The Online Store cannot guarantee access to services anytime, anywhere, or full service availability in all locations.
22.6 The Online Store is not liable for errors or omissions in Content and services, and published information may be changed without prior notice. The Online Store is not responsible for any losses arising from User reliance on Content or services. Users bear full responsibility for actions taken based on the services provided.
22.7 Please note that the Online Store is not responsible for individuals impersonating the Online Store to obtain information. Always verify that you are communicating with official support channels listed in this Agreement under “Contact Information.”
23. Changes to the Agreement. Governing Law
23.1 We reserve the right to review and amend the terms of this Agreement at any time. We do not send individual notifications about changes but publish announcements on the Online Store website. Continued use of the Online Store services after changes are published constitutes User acceptance of those changes.
23.2 Use of the Online Store’s services and procedures for purchase, payment, delivery, return, exchange, and Personal Data processing are governed by Ukrainian law.
23.3 All disputes under or related to this Agreement shall be resolved through negotiations. If unresolved, disputes shall be settled in court according to applicable Ukrainian law.
24. User Reviews
24.1 Users may leave reviews and recommendations regarding Products and services of the Online Store. Before posting reviews, ensure they are not illegal, harmful, threatening, defamatory, infringing on the dignity of others, violating copyright, or promoting hate and/or discrimination based on race, ethnicity, gender, religion, or social status. Reviews containing insults toward individuals or organizations or otherwise violating Ukrainian law are prohibited.
24.2 Users bear personal responsibility for their reviews and agree that any public postings may be removed by the Online Store without User consent. The Online Store is not liable for User-posted information and may choose not to publish reviews or links to them.
24.3 We collect feedback and recommendations to promote Products and services and to respond to inquiries and improve our offerings. To update or delete a review, contact us at info@oneluxy.com.

25.1 Users may contact customer support. Our managers will process inquiries promptly. When contacting support, please provide accurate information, avoid rudeness or profanity, show politeness and respect for others’ rights.
